OFFICIAL RULES & REGULATIONS
NO PURCHASE NECESSARY. Contest Closing Date: March 24, 2008
HOW TO ENTER: The "Home Gym" contest (the "Contest") begins on January 28, 2008 and ends at 11:59 pm EST on March 24, 2008 (the "Contest Period"). During the Contest Period, visit www.astro.ca and complete the Official On-line Contest Entry Form or hand-print your name, complete mailing address and daytime phone number, the answer to the mathematical skill-testing question, and a UPC number from a package of Astro Fat Free Zero yogourt on a plain piece of paper and send it to "Home Gym" contest P.O. Box 157, Station B, Toronto, ON, M5T 2T3. Only original hand-printed offline entries will be eligible; no photocopies or other reproductions. Each mail-in entry must be mailed in a separate envelope, bearing sufficient prepaid postage. Mail-in entries must be postmarked by March 17, 2008 and received by March 24, 2008. LIMIT: one entry per household or per e-mail address per month during the Contest Period.
GRAND PRIZES: There are three (3) Grand Prizes available to be won each consisting of a Home Gym, consisting of a Precor 535 Elliptical, Torque Fitness F5 Home Functional Trainer, Aerobics Pacemaster Platinum VR Treadmill, Bosu Ball, 65cm Gymnastics Ball, Northern Incline Bench and Select Tech DB set. The approximate retail value of each Grand Prize is $10,135.00. A cash surrender value of $8,000.00 CAD can be selected in lieu of a Grand Prize.
SECONDARY PRIZES: There are ten (10) Secondary Prizes available to be won each consisting of a Pacemaster Gold VR Treadmill. The approximate retail value of each Secondary Prize is $1,988.00. There is no cash surrender value for the secondary prize.
LIMIT: one (1) prize per person.
The odds of winning a prize in this Contest depend on the number of eligible entries received during the Contest Period.
ELIGIBILITY: Open to residents of Canada who have reached the age of majority in their province or territory of residence as of the first day of the Contest Period. You are not eligible if you are an employee, representative or agent of Parmalat Canada ("Sponsor"), its affiliates, subsidiaries, parent or related companies, advertising or promotional agencies, THE FITNESS DEPOT, the independent judging organization, or if you are a member of the immediate family or household of any such employee, representative or agent. For these Rules, "immediate family" means spouse, mother, father, son, daughter, sister and brother regardless of where they reside.
SELECTED ENTRANTS: A random draw for all prizes will be made on April 7, 2008, in Toronto, ON from all eligible entries received by the independent judging organization. Three (3) attempts will be made to telephone the selected entrants at the contact information on their Entry Form within three (3) business days of the random draw. To be confirmed a winner the selected entrant must (a) be reached by telephone within three (3) business days of the date of the draw; (b) correctly answer, without mechanical or other assistance, the mathematical skill-testing question on the entry form; (c) be in compliance with these Official Rules; and (d) sign and return within ten (10) business days of the date on the notification, a declaration of compliance with these Official Rules and a Release of Liability / Consent to Publicity form, releasing Sponsor, its affiliates, subsidiaries, parent and related companies, advertising or promotional agencies, and all of their respective directors, officers, owners, partners, employees, agents, representatives, successors, and assigns (collectively, the "Releasees") from any liability in connection with this contest or the prize. If a selected entrant cannot be contacted and confirmed a winner as described above, the prize may be forfeited and may be awarded to an alternate entrant. By accepting a prize, winner consents to the use of his/her name, city of residence, voice, statement and photograph or other likeness for any publicity conducted by the Sponsor in connection with this contest, without further compensation. Winners' names and cities of residence will be posted on www.astro.ca.
GENERAL
Incomplete, illegible or entries received after the Contest Closing Date will not be accepted. The Sponsor, its affiliates, subsidiaries, advertising and promotional agencies, and their respective directors, officers, employees and assigns, take no responsibility for lost, misdirected, illegible or late entries which for any reason are not received before the Contest Closing Date, or for printing, distribution or production errors and reserve the right to cancel or amend this Contest at any time for any reason, subject to the approval of the Régie des alcools, des courses et des jeux.
All entries are the property of the Sponsor and none shall be returned. All decisions regarding the Contest remain with the Sponsor. By participating in this Contest, entrants agree to comply with these Official Rules & Regulations. Only the prizes listed in these Official Rules & Regulations will be awarded. Should a computer programming, printing, or other error cause more prizes to be claimed than are intended to be awarded, such prize(s) will be awarded in a random drawing from among all prize claims received by the Sponsor before the Contest Closing Date. In no event will the Sponsor be liable for more than the prizes outlined herein. All prize claims are subject to verification.
The Sponsor and its advertising and promotional agencies each assume no responsibility for any failure of the web-site during the Contest, for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, access providers, computer equipment, software, failure of any e-mail or transmission to be received on account of technical problems or traffic congestion on the Internet or at any web-site, or any combination thereof including any injury or damage to an entrant's or any other person's computer related to or resulting from participation in the Contest. The Sponsor reserves the right, in its sole discretion to modify, cancel, suspend and/or terminate any or all parts of the Contest should a virus, bug or other cause beyond the reasonable control of the Sponsor corrupt the security or proper administration of the Contest.
The Sponsor and its respective advertising and promotional agencies assume no liability for any personal injury or property damage or losses of any kind, including without limitation, direct, indirect, consequential, incidental or punitive damages which may be sustained to a participant's or any other person's computer equipment resulting from a user's attempt to either participate in the Contest or download any information in connection with participating in the Contest or use of the web-site. Without limiting the foregoing, everything on the web-site is provided "as is" without any warranty of any kind, either express or implied, including but not limited to, the implied warranties of merchantability, fitness for a particular purpose or non-infringement.
The Sponsor reserves the right to disqualify any individual that it finds to be in violation of these Official Rules & Regulations or of tampering with the entry process. The Sponsor reserves the right to refuse an entry from a person whose eligibility is in question or who has been disqualified or is otherwise ineligible to enter. Entries generated by script, macro, robotic, programmed, or any other automated means are prohibited and will be disqualified. Any attempt by anyone to deliberately undermine the legitimate operation of this Contest is in violation of criminal and civil laws and the Sponsor reserves the right to seek damages or other legal remedy to the fullest extent permitted by law.
In the event of a dispute regarding the identity of the person submitting an entry, the entry will be deemed to be submitted by the "Authorized Account Holder" in whose name the e-mail account is registered, provided that person meets all eligibility criteria of this Contest. "Authorized Account Holder" shall mean the natural person assigned to an e-mail address and/or telephone number, by an Internet access provider, on-line service provider, telephone service provider or other organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
For Quebec residents, any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purposes of helping the parties reach a settlement.
We respect your right to privacy. Your personal information is collected solely for the purpose of administering this Contest and compiling consumer data. By entering the Contest, entrants consent to the manner of collection, use and disclosure of personal information as set out in the privacy policy available at www.parmalat.ca.
